Truncated transcript from today’s SCOTUS argument

For those of you who don’t want to read the transcript of the oral argument in Hollingsworth v. Perry, which is all of 82 pages long, or whose heads exploded when you tried to read it, I’ve written a helpful summary. It’s available below the jump.

This summary is still fairly long, but it’s shorter and I’ve worked to make things as accessible as possible to those without legal training.

As a result, there are some places where I might have oversimplified the legal argument. My summarizing might be partially colored by my personal viewpoints, but this is basically what happened, plus or minus the aliens eating children.

NY Times: House of Commons brings legal same-sex marriage one step closer to reality in England and Wales. More Info:

The House of Commons voted overwhelmingly on Tuesday to approve a bill legalizing same-sex marriage in Britain, indicating that the bill is assured of passage as it moves through further legislative stages.

But in a major setback for Prime Minister David Cameron, who championed the bill, it appeared that more than half of the lawmakers in his Conservative Party voted against the measure or abstained.

The bill is now headed to the House of Lords, where it can be slowed by the filibuster and other such delaying tactics, but is widely expected to pass in the end thanks to overwhelming public support for the measure. Prime Minister Cameron has said he hopes to have the law in full effect by this summer.

This is what modern conservatism should look like. Equality should not be a political position, it should be understood as something that applies to everyone. 

Wonderful step in the right direction, I hope the House of Lords doesn’t screw this up.

In case you somehow haven't heard by now: Supreme Court to Hear Two Challenges to Gay Marriage

“One of the cases, from California, could establish or reject a constitutional right to same-sex marriage. The justices could also rule on narrower grounds that would apply only to marriages in California.

The second case, from New York, challenges a federal law that requires the federal government to deny benefits to gay and lesbian couples married in states that allow such unions.

The court’s move against the backdrop of a rapid shift in public attitudes about same-sex marriage, with recent polls indicating that a majority of Americans support allowing such unions. After the elections last month, the number of states authorizing same-sex marriage increased by half to nine.”

Thousands protest same-sex rights in France

  • 100,000+protest against same-sex marriage and adoption in France today, according to police figures. A couple counter-protests were stymied by police, with 200 detained in Lyon, and teargas being deployed in Toulouse. Further protests in Paris tomorrow are anticipated; Pope Benedict XVI today called for a more vocal Catholic presence on French social issues. source

Come on France, what are you doing? And Pope Benedict needs to be reminded that the country is not a theocracy.

The maps break support for same-sex marriage down by county. Green and yellow dots represent counties where people support same-sex marriage, while orange and red dots represent places where people do not. As you can see, there’s no consensus across the country.

Chick-fil-a re-evaluates funding for anti-gay marriage groups

After weeks of negotiations with city Alderman Joe Moreno, the fast-food restaurant agreed to take “a much closer look” at which groups receive donations from the WinShape Foundation, a non-profit created by the Cathy family and funded almost entirely by Atlanta-based Chick-fil-A, the company told Moreno.

“The WinShape Foundations is now taking a much closer look at the organizations it considers helping, and in that process will remain true to its stated philosophy of not supporting organizations with political agendas,” Chick-fil-A’s senior director of real estate said in a letter to Moreno.

Between 2008 and 2010, the WinShape Foundation gave $3.2 million to groups that advocate against same-sex marriage, according to the group’s tax reports. That included $2,000 to the Family Research Council, which was designated as a “hate group” by the Southern Poverty Law Center in 2010, and $2,500 to the Alliance Defense Fund, which supported California’s Proposition 8 to outlaw gay marriage.

If true, they either A) got enough bad PR that it became a real problem or B) actually lost a lot of money. Either way, boycotts work!

NFL = No Foolish Lawmakers (not about sports, must read)

Football is my favorite sport and like most Americans, I’m thrilled that the NFL season has started, but I became an even bigger fan of the game and the league after reading this article from Politico.

Apparently, Brendon Ayanbadejo, a linebacker for the Baltimore Ravens, has been an open supporter of same-sex marriage and an advocate for a state law in Maryland that will uphold same-sex marriage in the state.  This led an ignorant delegate to the Maryland Assembly, Democrat Emmett C. Burns, Jr., to write a letter to the owner of the Ravens, Steve Biscotti, asking Biscotti to “inhibit such expressions from your employee” by muzzling Ayanbadejo and ordering the linebacker “to cease and desist such injurious actions.”

Instead, Biscotti, the Ravens organization, Ayanbadejo’s teammates, and players around the league have offered their support.  NFL Commissioner Roger Goodell defended Ayanbadejo by saying, “I think in this day and age, people are going to speak up about what they think is important.  They speak as individuals and that’s an important part of democracy.” 

The best statement of support, however, came from Minnesota Vikings punter Chris Kluwe, who wrote an open letter to Delegate Burns that might be the greatest piece of writing by an American since the Gettysburg Address.  I can’t help but post it in its entirety, courtesy of Deadspin:

Dear Emmett C. Burns Jr.,

I find it inconceivable that you are an elected official of Maryland’s state government. Your vitriolic hatred and bigotry make me ashamed and disgusted to think that you are in any way responsible for shaping policy at any level. The views you espouse neglect to consider several fundamental key points, which I will outline in great detail (you may want to hire an intern to help you with the longer words):

1. As I suspect you have not read the Constitution, I would like to remind you that the very first, the VERY FIRST Amendment in this founding document deals with the freedom of speech, particularly the abridgment of said freedom. By using your position as an elected official (when referring to your constituents so as to implicitly threaten the Ravens organization) to state that the Ravens should “inhibit such expressions from your employees,” more specifically Brendon Ayanbadejo, not only are you clearly violating the First Amendment, you also come across as a narcissistic fromunda stain. What on earth would possess you to be so mind-boggingly stupid? It baffles me that a man such as yourself, a man who relies on that same First Amendment to pursue your own religious studies without fear of persecution from the state, could somehow justify stifling another person’s right to speech. To call that hypocritical would be to do a disservice to the word. Mindfucking obscenely hypocritical starts to approach it a little bit.

2. “Many of your fans are opposed to such a view and feel it has no place in a sport that is strictly for pride, entertainment, and excitement.” Holy fucking shitballs. Did you seriously just say that, as someone who’s “deeply involved in government task forces on the legacy of slavery in Maryland”? Have you not heard of Kenny Washington? Jackie Robinson? As recently as 1962 the NFL still had segregation, which was only done away with by brave athletes and coaches daring to speak their mind and do the right thing, and you’re going to say that political views have “no place in a sport”? I can’t even begin to fathom the cognitive dissonance that must be coursing through your rapidly addled mind right now; the mental gymnastics your brain has to tortuously contort itself through to make such a preposterous statement are surely worthy of an Olympic gold medal (the Russian judge gives you a 10 for “beautiful oppressionism”).

3. This is more a personal quibble of mine, but why do you hate freedom? Why do you hate the fact that other people want a chance to live their lives and be happy, even though they may believe in something different than you, or act different than you? How does gay marriage, in any way shape or form, affect your life? If gay marriage becomes legal, are you worried that all of a sudden you’ll start thinking about penis? “Oh shit. Gay marriage just passed. Gotta get me some of that hot dong action!” Will all of your friends suddenly turn gay and refuse to come to your Sunday Ticket grill-outs? (Unlikely, since gay people enjoy watching football too.)

I can assure you that gay people getting married will have zero effect on your life. They won’t come into your house and steal your children. They won’t magically turn you into a lustful cockmonster. They won’t even overthrow the government in an orgy of hedonistic debauchery because all of a sudden they have the same legal rights as the other 90 percent of our population—rights like Social Security benefits, child care tax credits, Family and Medical Leave to take care of loved ones, and COBRA healthcare for spouses and children. You know what having these rights will make gays? Full-fledged American citizens just like everyone else, with the freedom to pursue happiness and all that entails. Do the civil-rights struggles of the past 200 years mean absolutely nothing to you?

In closing, I would like to say that I hope this letter, in some small way, causes you to reflect upon the magnitude of the colossal foot in mouth clusterfuck you so brazenly unleashed on a man whose only crime was speaking out for something he believed in. Best of luck in the next election; I’m fairly certain you might need it.

When gays get so angry about a chicken sandwich, it is because Chick-fil-A has given around $5 million to fight to discriminate against us. When we praise brave Eagle Scouts who give up their badges in protest of the Boy Scouts of America’s prejudice, it’s not about scoring political points; it’s because there are kids in dens who are being taught to believe that they are less than equal. When we rant about the pastor who preaches that gays should be thrown into a concentration camp, we scream out of fear. And our fears are justified — in the last seven days, a lesbian in Nebraska was carved with a knife, a gay man in Oklahoma was firebombed, and a girl in Kentucky was kicked and beaten — her jaw broken and her teeth knocked out — while her assailants allegedly hurled anti-gay slurs at her.
